Kimberly M. Foxx is the State’s Attorney (District Attorney) for Cook County in Illinois. She is in charge of the second-largest prosecutor’s office in the United States, which has about 700 attorneys and 1,100 employees.

Jussie Smollett
Foxx announced her withdrawal from the Jussie Smollett assault hoax investigation on February 19, 2019. Smollett staged an assault and filed a false report with the local police; Foxx’s recusal was criticized by her predecessor, Anita Alvarez, because of her “familiarity with potential witnesses in the case.”

Recusing herself would have necessitated Foxx requesting that the court appoint an outside attorney to serve as a special prosecutor. Critics criticized her method of recusal, claiming that because her office retained authority over the case, she had influence over how it was handled.
Her office dropped all charges against Smollett on March 26, 2019, which was condemned by Mayor Rahm Emanuel and Police Superintendent Eddie T. Johnson. The Chicago Police Union demanded that Foxx’s decision be investigated.
The Illinois Prosecutors Bar Association and the National District Attorneys Association both chastised Foxx. The Fraternal Order of Police in Chicago demanded her resignation. Smollett was convicted in December 2021 and sentenced to 150 days in county jail in March 2022.
