Progressive groups and Democratic members of Congress urged Breyer to step down so that President Biden could appoint a more youthful liberal justice after the party won the 2020 presidential and Senate elections. On January 27, 2022, he and Biden released an official statement at the White House announcing his impending retirement.

After 28 years of service, Breyer will leave the seat on June 30, 2022, after the court’s last rulings and orders for the term. In a letter to President Joe Biden, he stated that serving as a judge has been a “huge honor” for him. He will effectively retire on June 30, 2022, at noon.
